Article 1: Scope of application

These General Conditions of Sale (CGV) apply to any purchase of products or services made by any natural or legal person (hereinafter referred to as “customer” or “you” depending on the context) from the company Swiss Recycling Metals Sàrl (hereinafter referred to as “Swiss Recycling Metals Sàrl” or “we” depending on the context), via the website www.SwissRecyclingMetals.ch (and all subdomains), or via another remote communication channel, or physically on site. Swiss Recycling Metals Sàrl is the seller of the products and services.
You acknowledge that all contracts, notices, communications of information and other types of exchanges that take place electronically comply with legal requirements, which require that such exchanges be made in writing. Any oral agreement made between you and us must be confirmed in writing, otherwise they are all ineffective.
Swiss Recycling Metals Sàrl reserves the right to modify these General Terms and Conditions at its discretion; the applicable conditions are those in force on the site on the date your order is placed.
The authentic text of the General Conditions of Sale is in French. The original French language version takes precedence over its translations into all other languages.

Article 2: Special provisions

In addition to the General Terms and Conditions, special provisions apply for certain products or services: our waste buyback service (dental crowns, electronic waste, medical waste, etc.) is carried out under the General Conditions for the buyback of precious metals.

Article 3: Capacity to contract

You must be legally authorized to create a customer account (i.e. have reached the age of legal majority and have legal capacity and not be under guardianship or curatorship).
If you live outside Switzerland, find out before selling your waste whether your country authorizes export and resale; Swiss Recycling Metals Sàrl cannot be held responsible if the reseller violates the legislation of a foreign state.

Depending on your place of residence, you are subject to taxes as well as declarations to be made. You are required to report the sale of precious metals. Our company is not responsible for non-declaration.
We refuse all commercial relations with people who have American nationality or live in the United States of America.

Article 4: Price

Currencies: displayed price and invoiced price: the prices displayed on our invoices, and by default on our website, are always indicated in Swiss francs (CHF). However, it is possible to view the prices in euros (EUR) or dollars (USD) on the site for information purposes.

Article 5: Impossibility of canceling a sale

In accordance with Swiss and European law, there is no right of withdrawal when purchasing precious metals, as their price is subject to market fluctuations beyond our control and power. The consumer's right to cancel their transaction and recover the items sold therefore does not apply. Our purchases are firm, with no possibility of return.

Article 6: Guarantees and liability

1. Data protection: Discreet and secure processing of your personal and commercial data is guaranteed. Swiss Recycling Metals Sàrl complies with the Federal Data Protection Act. To find out about data security measures, refer to the “Legal notices” page.

2. We undertake to provide all the care customary in the profession for the implementation of the service offered to the customer. However, we cannot be held liable in the event of failure to fulfill our contractual obligations due to a fortuitous event or a case of force majeure as defined by the case law handed down by the Swiss courts.

Article 7: Choice of law and jurisdiction

These General Conditions of Sale (CGV) are regulated and interpreted in accordance with Swiss law, to the exclusion of the law on private international law and the Vienna Convention on the international sale of goods of April 11, 1980. Swiss law is applicable to any dispute between you and us.

1. Jurisdiction: In the event of a dispute arising from these General Terms and Conditions, the Geneva courts have sole jurisdiction, subject to appeal to the Swiss Federal Court.

2. Execution of the judgment: If you refuse to execute a court decision, it is stipulated by this clause that all costs of forced execution of the judgment in Switzerland or abroad would be exclusively your responsibility.

Article 8: Saving clause

If one or more assertions in our General Terms and Conditions were or became invalid or inapplicable under legislation or a court decision, these assertions would be applied within the strict limits of what is permitted by applicable legislation. The other provisions would remain valid and fully applicable.
